Sorry for the delay between updates, I've been consulting recently and been swamped for time -- and thanks to everyone for the various expressions of support ...
We went to court on June 26, and again, it went well. There's no real prospect in the immediate future of Alan getting to see the children unsupervised -- his fantasy going into this was that Amy was going to be thrown in jail and the kids were going to come to live with him. So far he still hasn't been permitted to see the kids, and what the judge appears to be considering is reunification therapy. This sounds horrible enough on its own merits, the 3 kids getting sent to therapy with a guy who's going to force them to deal with his psychoses and lies, because he won't -- but it's still an improvement on any scenario where he gets private time with them.
BTW -- when this blog began Alan pretended for some reason wrapped up in his habitual dishonesty, that he wasn't reading it. Asked people to let him know if anything from my daughters ended up on this blog, as if he weren't reading every post on it. Not surprisingly, he then printed out every post up to that point and attached it to one of his pleadings. Which was super clever of him ... because the Judge read it ... twice, he said. And was not happy to have this material out here in the public. But the important thing was, he read it, the entire thing, and plainly assimilated the material, which was a good job by Alan.
Alan's lawyer didn't show up for the last hearing. Alan's replacement attorney wanted to continue, which we agreed to if Alan would agree to no visitation plus an interim restraining order preventing him from driving by the house as he'd been doing -- just until the next court date. You can't really do business with Alan: he refused, which we knew he was going to. So we went before the judge gave us an interim restraining order preventing Alan from driving by the house, and no visitation....
We're going back to court on the 20th, working on the filing to have Alan's child support recalculated ... and getting into discovery. More about that, upcoming.
Any sff.net people still vaguely wondering if Alan's even remotely honest -- he denied in court having made the posts you all know he made. So, of course, all those posts are coming to court for the next hearing, and we're going to make Alan deny having made them, one by one ...

In his last filing, Alan Rodgers said ...
I thought about titling this "Alan Rodgers lied," but it seemed redundant....
In big bold print in his latest filing, Alan said to an actual judge, the following: "The DCFS found that Anthony's death was not the result of any negligence on my part."
This would be a great point for him in getting his hands on the son that he so-far-hasn't-killed, except that it's black-and-white untrue.
The Department believes that the father's carelessness in placing the baby at the end/edge of the bed, and his failure to take the baby downstairs with him contributed to this infant's death. The department believes that the mother knew or should have known that this father was not a safe caretaker of this infant. In addition, the parents failed to arrange appropriate specialized childcare for the Down's syndrome baby.
Therefore, pursuant to WIC 361.5 (b) (4), the parent caused the death of another child, the Department recommends that no Family Reunification services be offered to the father.
This was the Jurisdiction/Disposition report, which I've posted elsewhere on this blog -- though Alan quotes from this document elsewhere, he apparently managed to miss this section. It's at the end, and maybe that was too far to read. And besides, there was a big thing with a judge afterward -- maybe the judge found that Anthony's death was not the result of any negligence on Alan's part, and Alan's merely confused -- you know, the boy's got brain damage and all ...

A friend reading this blog the other day wanted to know why I consistently referred to Alan as Alan, and Amy Sterling Casil as "Casil." Though she doesn't like Alan much, my oldest daughter likes her name, and referring to Alan repeatedly as "Rodgers" in the context of all this vile subject matter might have made her feel bad. As to Casil, well, two Amy's in this story, and I don't want anyone mistaking one for the other -- as Alan appears to have. In his latest filing he goes on at length on the ridiculousness of anyone considering him an alcoholic -- quite a lot of it -- but this is the core:
"In petitioner's declaration, she alleges that I am 'a full blown alcoholic. He drinks every day and night, to go to sleep.' The petitioner has absolutely no personal knowledge of my drinking habits."
... because Amy Stout-Moran hasn't been around him for years and years and years and doesn't know a thing about his drinking habits. As with the bit above, this would be another great point ... except:
Amy Stout-Moran didn't call Alan a "full blown alcoholic." Amy Stout-Moran didn't say that Alan "drinks every day and night, to go to sleep."
Amy Sterling Casil did.

The Alan Rodgers Experience ...

I won't get a new post up until Saturday, but there will be one on Saturday. In the interim, since Alan's been bragging recently about his wealth, you can amuse yourself by recalculating his child support payments here:

Assuming Alan's not lying about having enough money to go rent a place on the beach and making a variety of assumptions about what sort of income that works out to be -- at $8500 per month actual income, I get about $3900 per month in child support.
Up until now he's been assessed $301. For all three kids, per month -- yes, $100.33 cents per child per month. By a judge in Oregon who probably accurately thought it was the most he could possibly come up with ... he hasn't paid that with great frequency over the years, and hasn't paid it in a year at this point. (And let me tell you, for the pleasure of a year without Alan's company, it's the best $3600 you could possibly imagine missing ...)
We never bothered recalculating his child support because he was so visibly hanging on by his fingernails most of the last decade. Apparently Alan now thinks he's rich ... we'll find out, eh?

I'm not sure what Alan's deleted since this went public (though we've got a complete copy of all his posts) -- but what's still up there is worth reading.

The Amy being mentioned below is Amy Sterling Casil, not my wife Amy ... which means that the two women Alan's ever had significant relationships with in his entire life have both sought restraining orders against him. (Not counting his own mother, though she probably had cause as well -- Alan used to tell a story where he'd assaulted his mother.)

Just heard from a police officer that Amy Casil is going to put a restraining order on me. When I told him I'd give whatever to the lawyer I hired on another matter (which see), he sounded intimidated and got off the phone. It's weird, because I didn't do anything to be restrained from. And especially weird because I've got logs of our IM conversations (which are honestly and especially crazy on her part -- giref over our lost child has her downright crazy on some things, I feel for her, and don't want to do this) that I'll have to give to the judge, where they'll get in the public record. She really doesn't want that. She needs to stop and think.
Would you believe no woman I was involved with has ever tried to get a restraining order against me?
Apparently -- I'd say amazingly, but Casil has ceased to surprise me -- Casil went back to Alan again after this. I've got about 4-5 more posts coming to get this blog up to the present day -- one of them is about Alan, and one of them is about Casil. (And one of them is about Alan and his child support -- he's been whining about his child support for years and years ... can you say $100.33 cents per child, per month?) And finally ...

Conclusion of the Jurisdiction/Disposition Report on Anthony's Death
I've bolded certain elements below. Nothing was bolded in the original. Comments by me are presented {... DM.}
This is the concluding section of the Jurisdiction/Disposition Report on Anthony's death. It begins bottom of page 33, and ends mid-page 35.

Concurrent Planning
The three Rodgers children are placed with the nonoffending mother, Amy Stout-Moran. There are no known problems with this placement. The Rogers children are older, and are unlikely to accept adoption. Should there be a problem with the home of the nonoffending mother, the most likely concurrent plan would be legal guardianship or long-term foster care.
Non-Reunification Issues (WIC 361.5)
Pursuant to WIC 361.5 (b) (4), the parents caused the death of another child through neglect, the Department does not recommend that Family Reunification services be offered to the father or to the mother.
Assessment/Evaluation
This family came to the attention of the department twice in the past six months. The first contact was in August, 2004, when an allegation was received that the father was playing too roughly with the baby. The baby had been diagnosed with Down's syndrome. Children's Services came out and assisted with referring the baby for Regional Center services. Children's services also gave the parents referrals for specialized childcare to assist them with caring for this special-needs baby. From the birth of the baby until two days before the baby died, the mother was the primary caregiver. During this time period, the mother reports she was working a few hours in the mornings. Two days after the mother began working a full time job, the baby died. The mother reports that she had not yet arranged specialized childcare for this infant. {"specialized care" ... like, most of the human race that wasn't Alan Rodgers. DM.} The mother states she believed the child was safe in the care of the father.
There were a number of issues causing problems in the relationship between Alan Rodgers and Amy Casil. The father has a history of extreme messiness, difficulty in holding down a job, anger issues, multiple medical issues, a history of drinking in the evenings, and a pattern of poor childcare abilities. The father's ex-wife reports that the father used to put on headphones to avoid hearing his children crying. The father's ex-wife also reports that the father was an angry person and even yelled at strangers. The father's ex-wife reports that she was the primary caregiver for their three children. As was the father's first wife, Amy Casil, apparently was the primary wage earner in this family. The father's medical issues may have resulted in short-term memory problems. The father's ex-wife reports a history of domestic violence in their relationship. The father and Amy Casil are reported to have had several yelling matches. Ms. Casil reports that the father has difficulty accepting criticism of his actions, and may even escalate his actions if he perceives himself as being criticized. The parents report that they had been about to separate when the mother discovered she was pregnant with this infant.
This home had no crib for the six–month old infant. However, there was a child safe seat in the living room, and a combination child playpen/enclosed sleeping area a few feet from where the father worked downstairs. According to both parents, there was no baby monitor in the home. On the day the baby died, the father states he placed the baby on his tummy, a few feet from the end of the bed. The father states the baby's head was near the edge of the bed, and the baby's feet were pointing towards the middle of the bed. The father states he then left the baby to work downstairs. It is uncertain how long the baby was left alone. {45 minutes at least. DM.} It is unknown why the father did not carry the baby downstairs with him where there was a suitable sleeping area. This baby had already fallen off the bed at least one other time. Both parents' state that they knew the baby could roll over.
According to the coroner's investigation, when the mother telephoned she heard her baby's voice in the background at approximately 7:30 PM. The mother reports that she arrived home a little after 8 PM. The mother reports she walked through the kitchen, said hello to her 12-year-old daughter, and immediately went into the bedroom to fill the humidifier to take care of the baby. However, at that time, the baby had gotten wedged between the railing and the mattress of the bed. The baby was not visible when the mother walked in, because there was a large black leather chair which had been pushed near the end of the bed. This chair blocked the view of the baby. The baby was found a few minutes later by the 12-year-old daughter. The baby had become wedged between the railing and the mattress, with its feet pointing to the floor and the head trapped between the lower railing and the mattress. The mother reports she immediately performed CPR on the baby. She reports large amounts of formula came out of the baby's mouth and nose. The mother also reports that there was vomit in two locations on the bed.
The mother states that she always placed the baby in the middle of the bed. The mother states she did not surround the baby with pillows, because she worried that the baby might get entangled in the pillows and smother. The mother states she has never seen the father place the baby onto the bed, because she had been the primary caregiver of this infant.
According to the examining coroner, this baby did not die from SIDS, or shaken baby syndrome. The radiology shows no signs of prior physical abuse or skeletal anomalies. According to the examining coroner, there is no evidence that the baby died as a result of having Down's syndrome or a cold. The examining coroner states, that his final report will likely state the cause of death as undetermined. According to the investigating detective from the Los Angeles Police Department Abused Child unit this case will likely be filed as an accident, and not as a homicide. {I'm going to track down the prosecutor who made that decision, and ask him why -- and see if in fact he had all the evidence at the time. DM.}

From the birth of the baby until two days before the baby died, the mother was the primary caregiver. During this time period, the mother reports she was working a few hours in the mornings. Two days after the mother began working a full time job, the baby died. The mother reports that she had not yet arranged specialized childcare for this infant. {"specialized care" ... like, most of the human race that wasn't Alan Rodgers. DM.} The mother states she believed the child was safe in the care of the father.
There were a number of issues causing problems in the relationship between Alan Rodgers and Amy Casil. The father has a history of extreme messiness, difficulty in holding down a job, anger issues, multiple medical issues, a history of drinking in the evenings, and a pattern of poor childcare abilities. The father's ex-wife reports that the father used to put on headphones to avoid hearing his children crying. The father's ex-wife also reports that the father was an angry person and even yelled at strangers. The father's ex-wife reports that she was the primary caregiver for their three children. As was the father's first wife, Amy Casil, apparently was the primary wage earner in this family. The father's medical issues may have resulted in short-term memory problems. The father's ex-wife reports a history of domestic violence in their relationship. The father and Amy Casil are reported to have had several yelling matches. Ms. Casil reports that the father has difficulty accepting criticism of his actions, and may even escalate his actions if he perceives himself as being criticized. The parents report that they had been about to separate when the mother discovered she was pregnant with this infant.
This home had no crib for the six–month old infant. However, there was a child safe seat in the living room, and a combination child playpen/enclosed sleeping area a few feet from where the father worked downstairs. According to both parents, there was no baby monitor in the home. On the day the baby died, the father states he placed the baby on his tummy, a few feet from the end of the bed. The father states the baby's head was near the edge of the bed, and the baby's feet were pointing towards the middle of the bed. The father states he then left the baby to work downstairs. It is uncertain how long the baby was left alone. {45 minutes at least. DM.} It is unknown why the father did not carry the baby downstairs with him where there was a suitable sleeping area. This baby had already fallen off the bed at least one other time. Both parents' state that they knew the baby could roll over.
According to the coroner's investigation, when the mother telephoned she heard her baby's voice in the background at approximately 7:30 PM. The mother reports that she arrived home a little after 8 PM. The mother reports she walked through the kitchen, said hello to her 12-year-old daughter, and immediately went into the bedroom to fill the humidifier to take care of the baby. However, at that time, the baby had gotten wedged between the railing and the mattress of the bed. The baby was not visible when the mother walked in, because there was a large black leather chair which had been pushed near the end of the bed. This chair blocked the view of the baby. The baby was found a few minutes later by the 12-year-old daughter. The baby had become wedged between the railing and the mattress, with its feet pointing to the floor and the head trapped between the lower railing and the mattress. The mother reports she immediately performed CPR on the baby. She reports large amounts of formula came out of the baby's mouth and nose. The mother also reports that there was vomit in two locations on the bed.
The mother states that she always placed the baby in the middle of the bed. The mother states she did not surround the baby with pillows, because she worried that the baby might get entangled in the pillows and smother. The mother states she has never seen the father place the baby onto the bed, because she had been the primary caregiver of this infant.
According to the examining coroner, this baby did not die from SIDS, or shaken baby syndrome. The radiology shows no signs of prior physical abuse or skeletal anomalies. According to the examining coroner, there is no evidence that the baby died as a result of having Down's syndrome or a cold. The examining coroner states, that his final report will likely state the cause of death as undetermined. According to the investigating detective from the Los Angeles Police Department Abused Child unit this case will likely be filed as an accident, and not as a homicide. {I'm going to track down the prosecutor who made that decision, and ask him why -- and see if in fact he had all the evidence at the time. DM.}
This child appears to have died as a result of becoming wedged between the bed railing and the mattress. There has been no determination by the coroner as yet as to the actual cause of death. Two days before the baby died, the primary caregiver, the mother took a full-time job. The father has a history of poor caregiving abilities. The father has a history of being an angry person, and intimidating those around him. The father states he placed the baby at the end of and near the edge of the bed. The father states he then the left the bedroom and went downstairs to work. The Department believes that the father's carelessness in placing the baby at the end/edge of the bed, and his failure to take the baby downstairs with him contributed to this infant's death. The department believes that the mother knew or should have known that this father was not a safe caretaker of this infant. In addition, the parents failed to arrange appropriate specialized childcare for the Down's syndrome baby. {"specialized" ... oh, never mind. DM.}
Therefore, pursuant to WIC 361.5 (b) (4), the parent caused the death of another child, the Department recommends that no Family Reunification services be offered to the father.

Court went well ...
I'll have a longer post tonight, but our first day in front of the judge couldn't have gone much better. Much too early for happy feet, but the short form is Alan got turned down on every request he made. Amy didn't get sent to jail, Alan didn't get to see his any of the children, my oldest daughter Alex slapped down Alan's lawyer in a downright gorgeous moment -- afterward my middle daughter, Andrea, turned to Alex and said, "You're my hero."
And what may have been Alan's most urgent request -- to prevent his biological children from posting the truth about him in public -- the judge dimissed that request with, "I don't see how I can do that."
